It’s Time to Speak with a Maritime Lawyer Miami! Interesting Facts You Should Know First

If you were to ask if anyone knew any cruise ship lawyers you probably wouldn’t get a lot of answers because typically maritime law isn’t something you hear a lot about. However, these types of lawyers are in high demand, and before you find yourself in a position where you may need one it’s crucial you know what maritime law is and some of the interesting facts about it!

Maritime laws cover matters that deal with workers who operate mostly at sea, navigation, the transportation of passengers, as well as supplies. When it comes to taking care of workers companies who have employees at sea are required by law to provide free medical care to anyone who gets injured while working on the ship. This includes any medicine that is required or any equipment that the employee may need. The same thing is true when there is a passenger that has been injured on a ship, but they must be able to prove that the injury was caused by the ship owners negligence. It is also the owner’s responsibility to ensure that, to the best of their knowledge, that the ship is safe for everyone on board. If there is any property that gets lost at sea that is also covered under maritime laws, the property can be claimed by a finder for an agreed-upon reward. There are contract salvage agreements that both the salvager and the person who lost the property must agree on an amount that will be paid as a reward. However, this does not apply when someone saves a life or property when it is in danger.

Some interesting laws that are included in maritime law can be found below!

  • The only time a foreign ship can board another vessel without permission is if the sailors or government aboard are engaged in piracy, the boat is involved in slave trade, the ship is without nationality, or it is engaged in unauthorized broadcasting.
  • Limitation of Liability act states that if the owner of a ship or a shipping company files a Limitation of Liability petition after a boat sinks it can limit any further claims against them to the current value of their boat. What makes this interesting is if the ship is completely submerged underwater than the value would be zero!
  • The law of salvage is in place to encourage the people at sea to help one another in times of need. If a person helps a boat that is in trouble, they are entitled to a reward for risking their own safety. The person who either helps the people on board the troubled ship or helps save the materials on board is known as the salvor. The reward amount is dependant on a number of factors, including the risk that was taken, how difficult the rescue mission was, and the value of the goods or boat that was saved.
